Summary of January 9, 2024 Nelson County Board of Supervisor Meeting

Present: Supervisors Parr, Reed, Rutherford, Legion.  Supervisor Harvey was absent.

THE REGULAR MEETING CONVENED AT 2:00 P.M. 

There was a Moment of Silence followed by the Pledge of Allegiance. 

I. REORGANIZATION OF THE BOARD AND ANNUAL ORGANIZATIONAL MEETING

  1. Election of Chair and Vice Chair: Supervisor David Parr was unanimously elected chairman. Supervisor Reed was unanimously elected vice chair. Newly elected Supervisor Legion was unanimously appointed to be the board’s representative to the Piedmont Workforce Network Counsel previously occupied by David Barton.

  2. Resolution – R2024-01 Annual Organizational Meeting of the Board set forth below was unanimously passed.

    “Regular meetings of the Board of Supervisors shall be conducted during Calendar Year 2024 in the General District Courtroom located in the Nelson County Courthouse in Lovingston, VA on the second Tuesday of each month, beginning at 2:00 p.m., and reconvening thereafter at 7:00 p.m. Should the regular meetings fall on any legal holiday, the meeting shall be held on the next following regular business day, without action of any kind by the Board; unless otherwise cancelled. Should the Chairman or Vice Chairman (if the Chairman is unable to act) find and declare that weather or other conditions are such that it is hazardous for members to attend regular meetings; the meeting(s) will be continued on the following Tuesday. Such findings shall be communicated to the members, staff, and the press as promptly as possible. All hearings and other matters previously advertised shall be conducted at the continued meeting(s) and no further advertisement is required. 

    Special meetings of the Board of Supervisors may be convened from time to time, as determined by the Board of Supervisors in accordance with the applicable provisions of the Code of VA and the Code of the County of Nelson, VA. 

    In accordance with the Code of the County of Nelson, VA, Robert’s Rules of Order, shall be observed as the rules for conducting the business of the Board of Supervisors and the agenda for all meetings of the Board of Supervisors shall be established by the Clerk of the Board in consultation with the Chairman.”

II. PUBLIC COMMENTS

  1. Alex Casillas addressed the Board to alert them that USDA funds are available to help people needing financial assistance in paying to install or repair septic systems and that he could help them access the funds through the Virginia Rural Water Association. He provided his email address and phone number to the board members for dissemination.  

  2. John Tani addressed the proposed increase in charges requested by Aqua Virginia which is pending before the State Corporation Commission, and which would start in January 2024. The hearing is set for April 23, 2024. If the SCC grants the request, the increase imposed in January would continue.  If the request is denied, an adjustment will be made to future bills. The proposed rate changes affect 445 Nelson County customers in Stoney Creek. Currently the applicable rates are $25 per month for 3,000 gallons per month and $47.90 for sewers. The rates would increase to $38 for 3000 gallons of water (52% increase) and $60 sewer (25% increase). Charges for usage over 3,000 gallons/month will be $8.58 /1000 gallons of water and $19.60 /1000 gallons for sewage. The case number is PUR-2023-00073 on the SCC website where comments may be posted on the SCC.  Those wishing to look through Aqua’s application will notice that the basis of the rate increase, is in large based on prospective infrastructure improvements to water and sewer systems in other communities across the state owned and operated by Aqua but does not include Wintergreen.  Botecourt County and Caroline counties have hired counsel to oppose the rate and Mr. Tani requested that Nelson County do the same.  

During the Board reports, Supervisor Reed indicated that he had spoken with Mr. Tani prior to the meeting and had investigated how the process of rate increase applications “worked”.  Supervisor William Pearson Reed opined that based on his research, the rate increase would probably be granted and the hiring of an attorney by the county would not prevent it. The board took no action on the request by Mr. Tani.

3. William Mays, President of Nelson County Farm Bureau Board of Directors informed the Board that there had been some confusion regarding the position of Nelson County Farm Bureau Board regarding land use/capital improvements in Nelson County which he favors so long as the County is “living within its means”.  He stated that the good working relationship with the Board is very important to the Nelson County Farm Bureau Board.   

4. Elwood Waterfield the III spoke about unspecified corruption and coverups in the county. While his comments were very critical and lambasted a few named and some unnamed people, it was impossible to determine what he was accusing anyone of doing.

IV. PRESENTATIONS

  1. VDOT Report: Mr. Brown reported that the Blendale Hollow structure replacement has been slow to be opened but VDOT hopes to open it this week. VDOT dealt with a snow/ice event in the mountains last weekend.  Regular maintenance has been ongoing including the trimming of brush on the side of the roads and in the medians.  Supervisor Reed requested that VDOT do a study regarding speed reduction to 45 mph on Route 151 from the county line to Beach Grove and truck traffic/possible restrictions on Routes 151/6. Mr. Rutherford requested Mr. Brown attend the Livingston Village Association meeting to discuss signs.  Jessica Legion requested and the rest of the Board joined in the request for a speed study of 29 from Lovingston to Colleen.  The Board as a group requested a study of all the intersections on 29 between Blue Moon, Vito’s, and Freshwater Cove. passed the Blue Moon. VDOT addressed a study they have initiated on the intersection of Nelson High School exit onto Route 29.  Supervisor Parr inquired about whether work he observed at the intersection in front of Saunders on Route 56 was VDOT’s. Mr. Brown answered that he did not know. Supervisor Reed made a motion which was unanimously approved that VDOT do a study regarding speed reduction to 45 mph on Route 151 from the county line to Beach Grove.  and truck traffic/possible restrictions on Routes 151/6.

  2. Thomas Jefferson Soil and Water Conservation District Programs (TJSWCD) Update: Ann Coates and Luke Longanecker presented the history and purposes of the TJSWCD as set forth in power point below.  The Conservation District was formed in 1939. There are 47 such districts in Virginia.  They are a government agency authorized through Code of VA 10.1-546 and are governed by a locally elected Board of Directors. The district includes Albemarle, Charlottesville, Albemarle, Fluvanna, Louisa and Nelson counties. The districts do not regulate but exist to help and cooperate with farmers.  

     VACS can help to: 

    • Improve and Protect Water Quality 

    • Increase Farm Productivity and Efficiency 

    • Improve Herd and Animal Health 

    • Control Erosion and Decrease Runoff 

    • Improve Soil Health and Drought Tolerance 

    • Improve Wildlife Habitat 

    • Sequester Carbon and Improve Groundwater Recharge. 

    Improve& Protect Water Quality, Conserve Soil & Scenic Beauty, and Improve Farm 

    Management and Farm Viability through Voluntary Incentive programs

V. NEW & UNFINISHED BUSINESS 

  1. Interest Free Loan Request – Wintergreen Rescue Squad (R2024-04): 

  1.      The Nelson County Board of Supervisors approved an interest free loan 

    request from Wintergreen Rescue Squad in the amount of $100,000 to help purchase a 2022 Ford F-450 Ambulance. 

    The request was unanimously approved.  

  2. Nelson EMS Proposed FY25 Shift Schedule Change: 

    Background: 

    Ideal NEMS Staffing: NEMS has 12 FT providers of which 9 have historically been Advanced Life Support/Paramedic (ALS) and 3 have been Basic Life Support (BLS)/EMT which is the ideal combination per the NEMS program manager Curtis Sheets of Wintergreen Fire and Rescue. The ideal shift is 3 ALS/Paramedics and 1 BLS/EMT Provider. 

    Current NEMS Staffing: 12 FT providers: 3 ALS/Paramedic Providers, 6 BLS/EMT Providers, and 3 Vacancies. They have been advertising to fill the vacancies with an emphasis on ALS/Paramedic providers with no ALS/Paramedic applicants as of December 19th. The current staffing provides for 1 ALS/Paramedic and 3 BLS/EMT Providers per shift, which may result in poorer patient outcomes and a higher probability of complaints. Roughly 2,000 people are treated annually with roughly 50% receiving some level of ALS care. If the County were to have all BLS/EMT staffed shifts, it would not only likely reduce patient care service levels, but it would also negatively impact revenue recovery by a few hundred dollars per call when ALS calls are handled by BLS crews. ALS calls handled by ALS crews are billed at a higher rate due to the higher level of patient care provided. 

     

    Current Schedule: 2 crews, stationed in Lovingston, providing 24/7 coverage: 4 providers per shift and 3 shifts who work 24 hours on/48 hours off for a total of 2,632 hours per year. 

    Surrounding Area Schedules: Amherst, Augusta, Buckingham, and Fluvanna work 24 hours on/72 hours off for a total of 2,190 hours per year. This is 442 hours LESS per year than the current NEMS schedule. 

    For comparisons sake, 40-hour per week full-time jobs consist of 2,080 hours per year. This has had a tremendous impact on NEMS provider attraction and retention. 

     

    Recommendations for Consideration: 

    • Work Schedule: As of July 1, 2024 (FY25) Move to a 24 hours on/72 hours off schedule but advertise it now in order to attract applicants and retain staff. This would require hiring 4 more NEMS providers for a total of 16 at an estimated total payroll cost of $281,000. $86,000 has been budgeted in the County’s Paid EMS budget for phasing of reduced work hours, leaving a deficit or net increase in funding needed of approximately $195,000 per year.   

    This Recommendation was unanimously approved for the remainder of the year 2023-2024 to be reviewed in considering the 2024-2025 budget.  

    • Ambulance Transport Billing Rates: Consider increasing ambulance transport billing rates to offset increasing service costs. This can be done at any time during the year. Ambulance bills are primarily paid by private insurance, Medicare and Medicaid and the County has a soft billing and hardship waiver program for patient payments. 

     This was continued to be reviewed with the 2024-2025 budget.  

  3. NCCDF Request for Support of Housing Opportunities via Fee Waivers (R2024-05): The Board continued unanimously approved waiving up to $500 in tipping fees for the remainder of the 2023-2024 budget for tipping fees at the County transfer station for debris generated by Nelson Community Development Fund (NCCDF) projects.

VI. REPORTS, APPOINTMENTS, DIRECTIVES AND CORRESPONDENCE

A. Reports 

1. County Administrator’s Report: 

  1. Welcome to the new South District Supervisor Jessica Legion! 

  2. Comprehensive Plan: The project website is www.Nelson2042.com.  Board and Planning Commission members have received final draft documents for review. The final draft of the 2042 Comprehensive Plan has been posted on the project website for public review and a press release issued regarding public review of the draft by the Planning Commission and Board of Supervisors. (see attached) Public Hearings have been scheduled, the first with the Planning Commission is on January 31st, 2024, at 7:00 PM., and the second with the Board of Supervisors is on March 20th, 2024, also at 7:00 PM. Both hearings will take place at Nelson County High School, 6919 Thomas Nelson Highway, Lovingston, Virginia 22949. Dissemination of this information is in progress. 

  3. Nelson County Service Authority (NCSA) Term Engineering Contract: County and NCSA staff are meeting with CHA, the contracted consultants on Wednesday, January 10th to establish the scope of the PERs for evaluation of the Lovingston water and wastewater system capacities, which will include evaluation of the Dillard Creek area for a water impoundment and treatment plant and revitalization/modernization of the old Lovingston wastewater treatment plant. Staff will advise the Board of the cost proposals for this work upon receipt.  

  4. DSS Building: The next work group meeting will be held on January 16th to review a preliminary floor plan and to discuss preliminary building interior and exterior design concepts. Staff has a zoom call scheduled with Davenport and Sands Anderson on financing options and timeline on January 11th. 

  5. FY24-25 Budget: The Agency request binder is being provided to the Board for review while staff develops the draft General Fund revenues and expenditures. A proposed budget calendar has been developed which includes General Fund budget introduction at the March 12th regular meeting, work-sessions to follow on Tuesdays and Thursdays through March and into April, if necessary, public hearing at the May 14th regular meeting, and adoption and appropriation at the June 11th regular meeting. (see attached) These dates are subject to change pending Board input and rate of progress. 

  6. Route 151 Corridor Study Update: VDOT’s online public survey on the updated plan concluded on January 2, 2024. Next steps will be coordinated between VDOT and staff. 

  7. Piney River Solar, LLC Special Exception 2023-369 – Amherst County: NO CHANGE This matter has been further deferred until February 20th.

LOCAL BOARD OF BUILDING CODE APPEALS 

Establishment: Established per Section 36-105, of the Code of Virginia, 1950 as amended and Section 119 of the Virginia Uniform Statewide Building Code effective March 1, 2011, and Ordinance O2011-05 adopted August 9, 2011 

Term: Four-year terms except for the first three initial appointees’ terms shall expire on June 30, 2012. The remaining two appointees’ terms shall expire June 30, 2014. Members may be re-appointed without limitation. A member appointed to fill a vacancy shall serve the unexpired term of the member being replaced. At the request of the Board of Supervisors, a serving member may sit beyond the expiration of his term until such time as his successor may be appointed; however, the successor’s term shall not be extended by such delay. 

Composition: Members of the LBBCA shall be selected by the Board of Supervisors on the basis of their ability to render fair and competent decisions regarding application of the USBC and shall to the extent possible, represent different occupational or professional fields relating to the construction industry. At least one member should be an experienced builder; at least one member should be a licensed architect or professional engineer, and at least one member should be an experienced property manager. Employees and officials of the locality shall not serve as members of the LBBCA. 

Summary of Duties: 

To rule on disagreements between the local enforcers of the Virginia Statewide Fire Prevention Code ("the SFPC") or the Virginia Uniform Statewide Building Code ("the USBC") and those persons being regulated under the codes. The power of the local board of appeals is to, when presented with an appeal, rule on the application of the SFPC or USBC by the enforcing agency or to rule on the enforcing agency's denial of a modification request. In exercising these powers, the local board of appeals may reverse or affirm, wholly or partly, or modify any decision under review as well as to determine whether an appeal is properly before them 

Meetings: 

The LBBCA shall meet at least once annually to ensure a duly constituted board, appoint officers as necessary, and receive such training on the USBC as may be appropriate or necessary from staff of the locality. Members are compensated $75 per meeting.

provide rehabilitation and other services to help individuals attain or retain self-care or self-support and such services as are likely to prevent or reduce dependency and, in the case of dependent children, to maintain and strengthen family life.

III. PUBLIC HEARING: Jeri Lloyd and William Purvis spoke in favor of the proposed Amendment to Chapter 11, Taxation, Article I, Sec. 11-5.1 Exemption and praised the volunteer fire and rescue staff serving in the county for Volunteer Fire and Rescue Members.   

A. Ordinance O2023-08 – Amendment to Chapter 11, Taxation, Article I, Sec. 11-5.1 Exemption 

for Volunteer Fire and Rescue Members set forth below was unanimously approved. A discussion arose regarding how to provide a benefit to volunteer fire fighters and rescue workers who don’t live in the county. Supervisor Rutherford suggested a cash payment, Supervisor Reed opposed cash payments to non-employees. Supervisor Parr redirected the Board to the ordinance before them and requested that the Board address the Amendment to the ordinance as written and address any recompense to non-resident volunteers to a future meeting.   

The Ordinance proposed for passage amends Chapter 11, Taxation, Article I, Sec. 11-5.1 Exemption for Volunteer Fire and Rescue Squad Members.  

“Proposed amendments to Section 11-5.1 would change the exempted amount of personal property taxes from the first five thousand dollars ($5,000.00) of assessed value to a credit of three hundred dollars ($300.00) on the personal property tax bill of eligible volunteer fire and rescue squad members. 

Sec. 11-5.1. Exemption for volunteer fire and rescue squad members. 

(a) Members of the Nelson County Volunteer Fire Department and Rescue Squads shall be exempted from paying taxes on the first five thousand dollars ($5,000.00) of assessed value granted a credit of up to three hundred dollars ($300.00) on their personal property tax bill. The chief or captain of each squad/department shall provide to the Commissioner of the Revenue by June 1st of each year a certified list of all members who are eligible for the exemption during that year. 

(b) A qualifying volunteer must have completed one hundred (100) hours of volunteer activities during the preceding twelve (12) months.”
